About Cancer Misdiagnosis & Delayed Diagnosis Claims

Cancer claims usually concern delay: symptoms or abnormal test results that should have triggered urgent investigation were dismissed, misread or not followed up, and by the time the cancer was diagnosed it had advanced — requiring more aggressive treatment or reducing the prospects of cure. The most common failing is a GP not referring a patient with red-flag symptoms, but delays also occur in screening programmes, radiology reporting and hospital follow-up.

NICE guidance (NG12) sets out the urgent suspected cancer referral pathway — previously known as the "two-week wait": patients whose symptoms raise a suspicion of cancer — for example rectal bleeding, a persistent lump, unexplained weight loss, post-menopausal bleeding or a persistent change in bowel habit — should be referred urgently, and under the NHS Faster Diagnosis Standard (which replaced the two-week wait in England in October 2023) cancer should be confirmed or ruled out within 28 days of referral. For care before October 2023, the two-week wait was the applicable standard. A failure to refer when the guidance clearly called for it, or a failure to act on an abnormal scan, smear or blood result, can be strong evidence of negligence.

The critical legal question is usually causation: what difference did the delay make? Expert oncology evidence compares the likely stage, treatment and prognosis at the time diagnosis should have happened with the position when it actually happened. A delay that changed curative treatment into palliative care, or required mastectomy or stoma surgery that earlier diagnosis would have avoided, founds a substantial claim.

Compensation typically ranges from £30,000 where the delay caused additional treatment and avoidable suffering, to £250,000–£1.5 million where it caused a materially worse prognosis, more radical surgery or reduced life expectancy. Where the patient has died, the family can claim under the Fatal Accidents Act 1976. The limitation period is generally 3 years from the date of knowledge of the delay.
